Pimpin’ aint easy! Seriously though, what do you mean by ‘you and me?’ Landlords get the most out of Prop 98, so are you referring to my past history as a landlord?
I’m renting right now, and even if that weren’t the case, I’m not the greedy type. Of course I’d want to see a profit on my investment, but in modest proportion to my monthly payout on the property, not a windfall at the expense of innocent families.

Thank you Sarah for taking over my posted story. Kudo’s not necessary. When the cause is right you need to take an active role no matter how many years it takes. Prop 13, which many have benefited from, did not happen overnight.

Those are two awfully partisan lists, I have to admit.
So let me see if I can get the story straight.
Prop 98 was written first by Republicans (arguably) to repeal rent control. The authors of Prop 99 sued Prop 98 prior to the prior referendum’s submission and lost (I read the decision and I couldn’t keep a straight face), only to realize that they could instead out legislate the legislators (I feel like there’s an echo in here) and poison pill 98 out of existence. Is that about right?
What’s so terrible about that? Like I said, the Republicans got played. That’s politics. I can’t vote for or against a state law simply because I disagree with the tactics used to get it on the ballot, but incidentally I don’t in this case.
I’m sorry but I still get the feeling that 98 is sneaky and loaded up with gobbledygook. 99 is simpler and can be amended. I’m worried about eminent domain abuse, but in the current market I’m more worried about tenant abuse.

You agree that any “investor” has the right to make a “profit.” That would include Albertson’s, Dell Computer or the owner of your local service station. The same logic applies to anyone who builds an office complex or invests in any form of housing. In fact we read that the housing market in southern Ca may have crashed upwards of 20 percent in the past two years. However it’s called “risk, reward.” What about all of the developers who are sitting on unsold units or acres of open space while they continue to pay off their bank loans?
We just received a notice from our State Farm agent indicating that due to higher replacement costs, should we file a claim, our policy premium will increase even when we have never submitted any claims.
“Payout” you say. “Modest ROI.” Do you have any idea as to how much of an investment is made by the buyer/property owners? For those carrying mortgages do you have any idea as to whether or not the subject rental properties are break even or “cash cows.” And even if they are, are you misleading the rent controlled readers in thinking that their leases and/or rents will double or triple as they remain in these rent controlled homes of whatever form they may be?
After a while the “spin cycle” of proponents of Prop 99 can get out of control.
Maybe you would be happier if property owners simply stopped providing rental spaces for affordable housing altogether. Perhaps they should convert rental apartments into condo’s for sale as they did on Marguerite Parkway in Mission Viejo several years ago. Forget housing. Let’s just build more sports stadiums and shopping centers so we don’t have to deal with disgruntled tenants. Would that make you feel better?
“Innocent families?” Are they being evicted once Prop 98 passes? NO! The bad guys who take risk in buying property and letting you live in (rent controlled space) for as long as you wish as long as you pay your rent and don’t trash the place or cause problems such as throwing wild parties leading to code enforcement calls.
Are you proposing the latest in the growing list of “Nanny State” controls. Setting your own concept of what ROI we are entitled to? What next, how much we can sell our houses for based on some formula that you create!

The slippery slope argument. I see.
I still hold that the market problems are the result of a long overdue adjustment. I’m sure you agree that real estate in all of Southern California has been overvalued for the better part of 3 years?
This isn’t a matter of enacting rent control or nanny-anything. It’s a matter of timing. When the recession is at its worst, that’s when you decide to remove the safety net?
When property prices better reflect actual values, then you’ll be absolutely, 100% right, but the way it looks now, landlords are seemingly trying to bring in more rent revenue to make the payments on the mortgages they couldn’t afford.
There’s your risk vs. reward scenario: too much risk here still leads to too little reward for the landlords and the tenants end up paying the price.
The same can also be said for commercial rental properties as opposed to multi-unit homes, except that as I’ve stated before, the economy and market tends to hurt them much less, so instead they just stand to gain even more.
You also neglected to mention that Prop 98 grandfathers in current tenants, but like I said, that just opens the door to tenant abuse because once they’re out of their current units, they may be priced out of the entire county.

Sarah. We are two ships passing in the daytime. Let me respond to yur ocmment sandwiched between my earlier comments.
Prop 98 was NOT “written first by Republicans (arguably) to repeal rent control.”
Prop 98 was written to provide property rights protection for ALL forms of private property which were not coverered in (D) Assemblyman De La Torre’s AB887 and ACA-8 proposed legislation.
The proponents of Prop 99 sued the State of CA by challenging the “title and summary” of Prop 98 which were selected by our Sec of State (or the Attorney General’s department).
“The honorable Timothy Frawley of the Superior Court of California rejected a lawsuit by a coalition of politicians and developers against the State of California contending that Proposition 98’s title and summary is misleading. The court ruled with the State that the “chief” purpose of Prop 98 is to reform eminent domain abuse.”
Let me suggest that you ask your friends at Prop 99 to show you the actual documentation as referenced above.
“Prop 99 is simpler”? You bet. It doesn’t do anything other than provide a tool to block the votes of our supporters should we exceed 50% plus one on June 3rd. There’s the “poison pill.”
Hmm. What does Prop 99 do anyway? Let me quote directly from The Independent Legislative Analyst as found on page 15 of the Primary Election voter information guide.
“Under current law and practice, government seldom uses eminent odmain to take single-family homes. Even when it does, the acquisition often is for a purpose that is permitted under the measure (such as construction of a road or school). Accordingly, this measure would not change significantly current government land acquisition practices.”
I rest my case.

Motive behind legislation is always important to understand.
The motive behind Prop 99 is to defeat Prop 98.
Prop 99 protects government’s currently expanded rights to take PRIVATE property for PRIVATE use;
Prop 98 defeats government’s appetite to gain control of our property rights and limits takings for PUBLIC uses only;
Prop 98 provides absolute private property rights to the property owner;
Prop 99 provides government with absolute rights to take our property.
Please vote YES on 98 and NO on 99.

Sarah. I knew that before I wrote it. My point was to follow what we have agreed on. You know. That former Democrat who saw the light in later life and became a Republican later stating that we should “trust, but verify”
Although I can make mistakes I devote a great amount of time researching and multi-sourcing my data. Now if I would only spend half that time spellchecking my posts and comments that would be wonderful.
