Border Jumper. While I cannot speak for the taking of land to build the "border fence" as I was not following that detail I can tell you that I have supported Latinos in Baldwin Park (LA) when the city attempted to have Bizno Develpment "take" their homes and business properties for a non public use when they had no desire to sell.
I have also traveled to the east coast to support black, brown, yellow and white property owners against bogus declarations of blight in this country.
Back to the fence. While I have spent many hours over the past decade fighting for the underdog against big government eminent domain activities, the fence falls under what they label a "valid public use." The same is true every time they widen a freeway and need to take homes or businesses. If you read the Fifth Amendment you will discover that we are not protected in those cases.
PS: My property rights support is totally voluntary. I receive no compensation for this personal ministry. The FCC can put bloggers under the microscope for our First Amendment efforts but will find no compensation coming this direction.

Don't get me wrong. I am relieved and elated to hear that no property will be taken, because of the same reason I opposed the theft of properety for the border wall. And it is this, Once property is taken away by government it makes it easier each time they take to take again. It establishes a precedence. I will caution you though if you think the no build killed the highway; do not be so sure. Election time is nearing. Tricky Ricky knows how to manipulate. Re-Elect Tricky Ricky Perry and I can almost gaurantee you that the highway project will be reborn. But as usual, like Pres Bush re-election, people are afraid to make changes to their life so he will probably win again. Anyway it is no gaurantee that a new governing self interested idiot will not do the same. Which is why I do not vote. So that I may be free to complain on all sides. From sea to shining sea.

Great win for white property owners. Where were these lawyers when Rio Grande Valley border land owners were trying to save their property from being stolen for the building of a border fence. Until you bring down the border wall and return the property to the rightful owners you self conservatives can shut up and stop telling me you all are for property rights. That includes you Seany Hannity, and those who said just build it, they are unamerican, how dare they try to keep the government from building the wall, wait a minute government can't do anything right, on second thought yeah the government is right, well maybe this time only, build it, take their land, protect Hannity And Rush And Beck. Better said you all are for your own property rights. One nation, with liberty and justice for some.
