U.S. Congressional Candidate Lee McGroarty Calls for Criminal Investigation of Congressman Gary Miller in Earmark Funding Scheme…May 4, 2010

Summary: Congressman Gary Miller has used Federal Earmarks to finance his own Political Action Committee (PAC) as well as funneling these same Earmarks to influence his pending land deal in Rancho Cucamonga, California.
On the morning of May 4, 2010, Lee McGroarty met with the San Bernardino County District Attorney’s Office and provided a detailed packet of information regarding a series of questionable dealings by Congressman Gary Miller (R) 42nd Congressional District, California.

Mr. McGroarty and his campaign released the following statement:

As a candidate for United States Congress and a Primary Election opponent of Mr. Miller, I want to make it clear that it has never been my intention to use Congressman Miller’s past scandals as a campaign strategy or advantage. My focus has been on fundamental differences with Mr. Miller on key issues, primarily fiscal issues such as his votes on sub-prime lending, TARP, TALF and Cash for Clunkers,  and these allegations are as much issues-related as they are possibly criminal. The information contained in the packet is based on CURRENT activities by Mr. Miller and not directly connected with any past scandals, though a pattern of corruption appears similar in numerous past allegations.


Several months ago, I began to notice a pattern of frequent earmarks (many outside our district) that were sponsored or co-sponsored by Congressman Miller.  Looking more closely at these earmarks, I discovered that many were intended for three non-profit organizations that shared a common address in Rancho Cucamonga.  I also noticed that all three organizations were connected to Jeffrey Burum, whom media reports have identified as an un-named co-conspirator in “one of the most appalling corruption scandals in California history” as defined by Attorney General Jerry Brown.  District Attorney Mike Ramos called the allegations “the biggest political corruption scandal in San Bernardino County’s history.” When this recent scandal broke in San Bernardino County, with numerous references to Burum’s possible involvement in “conspiracy, corruption and bribery”, I felt it was my duty to inform not only the San Bernardino County District Attorney’s office, but also the voters of the 42nd District.
Making matters worse, Congressman Miller has a personal land deal pending before the Rancho Cucamonga City Council and citizens have raised concerns that Congressman Miller is influencing the Council’s decision in granting the zoning approval. Please note that Rancho Cucamonga is located OUTSIDE Congressman Miller’s 42nd District.
Our records will also show that Congressman Miller has received more than $50,000 in campaign contributions from Burum and his associates since 2004, around the same time as his land purchase.
At best, the facts contained in this packet show a conflict of interest and questionable ethics; and at worst, may show criminal activities, but that is for the District Attorney to decide. I am calling for the DA’s office to expand their investigation to include Congressman Gary Miller and his involvement with Jeffrey Burum, his earmarks and his pending land deal with the Rancho Cucamonga City Council. We have also passed this on to the FBI which has been investigating Congressman Gary Miller for a similar land deal in Monrovia, CA as well as the California Attorney General’s Office.
Whether criminal or just the smell of corruption, the People will decide if “politics as usual” is to be rewarded on June 8th or whether it is time to clean house — and that goes for both Republicans and Democrats. I am asking my Party, the Republican Party, to join me in cleaning our own house.
