U.S. Congressional Candidate Lee McGroarty Calls for Criminal Investigation of Congressman Gary Miller in Earmark Funding Scheme…May 4, 2010
Summary: Congressman Gary Miller has used Federal Earmarks to finance his own Political Action Committee (PAC) as well as funneling these same Earmarks to influence his pending land deal in Rancho Cucamonga, California.
On the morning of May 4, 2010, Lee McGroarty met with the San Bernardino County District Attorney’s Office and provided a detailed packet of information regarding a series of questionable dealings by Congressman Gary Miller (R) 42nd Congressional District, California.
Mr. McGroarty and his campaign released the following statement:
As a candidate for United States Congress and a Primary Election opponent of Mr. Miller, I want to make it clear that it has never been my intention to use Congressman Miller’s past scandals as a campaign strategy or advantage. My focus has been on fundamental differences with Mr. Miller on key issues, primarily fiscal issues such as his votes on sub-prime lending, TARP, TALF and Cash for Clunkers, and these allegations are as much issues-related as they are possibly criminal. The information contained in the packet is based on CURRENT activities by Mr. Miller and not directly connected with any past scandals, though a pattern of corruption appears similar in numerous past allegations.
Several months ago, I began to notice a pattern of frequent earmarks (many outside our district) that were sponsored or co-sponsored by Congressman Miller. Looking more closely at these earmarks, I discovered that many were intended for three non-profit organizations that shared a common address in Rancho Cucamonga. I also noticed that all three organizations were connected to Jeffrey Burum, whom media reports have identified as an un-named co-conspirator in “one of the most appalling corruption scandals in California history” as defined by Attorney General Jerry Brown. District Attorney Mike Ramos called the allegations “the biggest political corruption scandal in San Bernardino County’s history.” When this recent scandal broke in San Bernardino County, with numerous references to Burum’s possible involvement in “conspiracy, corruption and bribery”, I felt it was my duty to inform not only the San Bernardino County District Attorney’s office, but also the voters of the 42nd District.
Making matters worse, Congressman Miller has a personal land deal pending before the Rancho Cucamonga City Council and citizens have raised concerns that Congressman Miller is influencing the Council’s decision in granting the zoning approval. Please note that Rancho Cucamonga is located OUTSIDE Congressman Miller’s 42nd District.
Our records will also show that Congressman Miller has received more than $50,000 in campaign contributions from Burum and his associates since 2004, around the same time as his land purchase.
At best, the facts contained in this packet show a conflict of interest and questionable ethics; and at worst, may show criminal activities, but that is for the District Attorney to decide. I am calling for the DA’s office to expand their investigation to include Congressman Gary Miller and his involvement with Jeffrey Burum, his earmarks and his pending land deal with the Rancho Cucamonga City Council. We have also passed this on to the FBI which has been investigating Congressman Gary Miller for a similar land deal in Monrovia, CA as well as the California Attorney General’s Office.
Whether criminal or just the smell of corruption, the People will decide if “politics as usual” is to be rewarded on June 8th or whether it is time to clean house — and that goes for both Republicans and Democrats. I am asking my Party, the Republican Party, to join me in cleaning our own house.

Lee is just trying to hide the fact that he had his corporate licenses suspended and admitted he is being investigated by the Federal Election Commission.

Greg, Three Corners admits they got their info from Lee’s website originally, how does that make him trying to “hide” anything? To be honest, I stopped reading Three Corners because I looked back at their inception and found out that they started not long after the first candidate (McGroarty) anounced they were running against Miller. Since that time, they’ve posted mostly negative things about McGroarty and Liberatore, without once every criticizing Miller for his horrible voting record and attendence. It seems to me that they are just a front for Miller and his supporters and not truly a blog representing the district’s voters.
Oh, p-l-e-a-s-e! I am so eager for the Primary Election to be over, I can’t stand it. These jackasses that went to a Tea Party and couldn’t find their way back home are still trying to get in front of the crowd. Look at the number of goofballs who are running for Central Committee because Glenn Beck told them that America needs a bunch of nonachievers in office who haven’t done anything their entire lives.

Good one, Jeff. It’s interesting no one has broken the ice about the Republican Central Committee and the non-Republican group that wants to take it over. At least I haven’t read about them. Maybe it’s because they’re not big enough to be on the map.
When I heard Lee McGroarty speak, I was impressed, and I thought he had a nice campaign team. I liked all of them. The big question for me was when the group from San Juan Capistrano (the anti-Republican pod) became McGroarty’s cheerleaders. Why is that? It then dawned on me that McGroarty is not a Republican either.
All of them should be running as Libertarians or whatever they are instead of trying to lug that big “R” around.
The group (pod) you are talking about calls itself Leadership Alliance.
McGroarty should have run as a Libertarian instead of trying to knock off Gary Miller in the primary. Wouldn’t that make more sense?
BTW, I don’t think they’re Libertarians. McGroarty and the people running for GOP central committee are more like American Independents. Isn’t that what Jim Gilcrist is or was?

I spoke to Lee about your comment. What you are not reporting is that his number changed when he combined two companies.
According to Lee the state of CA admits to a delay in their processing of this revision. His corporate licenses were NOT suspended as you charge.

In response to my call for a criminal investigation, Congressman Miller was interviewed by The Inland Valley Daily Bulletin, the newspaper in San Bernardino County. Miller said the following “If he wants to run to the newspaper like a little girl then go ahead. If I wasn’t a politician, then I’d sue.” Congressman Miller, for starters, I went to the DA’s office and provided evidence that I believe may assist in an already ongoing investigation of corruption in San Bernardino County, Second, I take offense to your little girl comment. I am running because of my three little girls, who are all under the age of 10 years old. Third, you wouldn’t be getting earmarks that benefit your business interest if you were NOT a politician. As a politician, you are held to a higher standard. If there appears to be a conflict of interest, then avoid any sense of impropriety. Congressman Miller, you are constantly in the middle of these “conflicts”. Don’t you understand that your actions do matter, especially when you are using our Federal Tax Dollars?
I am running because a Conservative Republican Congressman claims to be against spending yet runs up a TAB on the American People via Earmarks. Miller can have excuse after excuse but doesn’t anyone understand that we are supposed to be against spending and PORK? Does anyone question why Miller is getting Earmarks in the first place? For the record, I am a Republican. I always have been. I am very proud to have received the endorsements of the Conservative Party (California), iCaucus, SOC912 just to name a few. I chose to run because Miller voted to weaken the standards of Fannie Mae, Freddie Mac and FHA that caused the economic meltdown. He then voted for TARP, TALF and Cash for Clunkers. John Boehner on March 11th called for a MORATORIUM on Earmarks by Republicans. Why did he issue that moratorium? Could it be for people like Miller? I think I know the answer.
For those who criticize Libertarians, Tea Parties or people like me that want what is best for our country, I ask them this question: Do you care that Miller is getting earmarks? Do you care that he constantly gets earmarks outside his district…all of which his business or parnters have land deals pending? Do you care that he voted for TARP and Cash for Clunkers? What kind of Republicans or conservatives are we that we can’t hold our elected officials accountable for their actions? I asked other politicians to run against Miller and they all refused because their “political careers” will be cut short by the Republican Party and the Miller machine. Frankly, I am tired of electing career politicians that spend more time getting elected than they do representing the People of their district. I am running to give people a choice in June. We deserve better and I know I am better that what Miller has shown in his 12 years. Join me in standing up for the people of our district or stay with him and continue to get mediocrity and scandal that will surely follow this elected official.

The white elephant in the room is now Gary Miller’s vulnerability. Is the Republican party going to gamble a seat like the 42nd on a guy with unbelievable baggage like Miller. If McGroarty’s team can come up with some VERY real allegations in a few short months with no real money behind them, how much more will the Democrats bring in November if Miller wins the primary? CRA, the Lincoln Club and every other Republican group out there REALLY needs to think this one through. Can we really afford to make that big of a gamble on a VERY safe seat when the air is already so hostile to incumbents?
Very disapointed in Lee McGroarty’s attack on Congressman Miller. What FACTS do you have? What SKILLS do you have to make these claims? I am a Tea Party supporter that is very disenchanted with Lee McGroarty and his shameful “Mud Slinging” tactics. Public discourse is an important tool in our Democracy but “Mud Slinging” has no place in our political deliberations. These strategies have NO place in public debate. Distortions and lies have NO place in our Democracy.

Let’s begin with the fact that I posted a “press release” from their campaign office. Neither Art or myself made up the text. I confirmed that they in fact did meet with S.B authorities as they presented their complaint.
Mud slinging? Do you get any mail from Meg or do you watch any TV? Now that’s mudslinging which is the current way campaigns are conducted.

(It says Gary Miller Criminal Investigation) The facts are all there with links. It’s a bit hard to read right now, but seems like a website problem. I’d say he did his homework….there is a lot of info there.
What is up with all of these corrupt politicians Democrats and Republicans? Our community cannot continue to gamble on these people to represent us. Most people just want less government in all aspects of their lives. If Gary Miller is corrupt, he should just be out of office, starting now! Get the crooks out! We need a true conservative – Strong values, Fiscal responsibility, Less Government. We need our representatives to “keep their noses clean”. That’s why I’m voting for Phil Liberatore for our 42nd District.
