I am not certain if any quantitative research has been done on this.
I would say that race is not an issue among jurors,I would hope that a jury is looking at the crime and the facts involved in the case. I can tell from this question that you are able to think, and pose a legitimate question –and that it would be interesting to see the results.

Your position that the author is biased makes me think, that if true, you are no better.
The OJ trail and the Rodney King trail are examples where jury make-up, some believe was biased.
A study of the statistics then would settle the bias question and set plans in motion to make corrections to whatever causes high non-whites to populate the prison system.
I believe the disproportionate question is a mixture of issues and not only a jury issue.
A study is a win – win undertaking.
The DOJ provided statistics not analysis, of course, but the simple conclusions to be drawn from them are quite simple.
Among its findings at the time were that of 18 prisoners on federal death row, 16 were either African-American, Hispanic or Asian. The ACLU highlighted the following, “From 1995-2000, 80% of all the federal capital cases recommended by U.S. Attorneys to the Attorney General seeking the death penalty involved people of color. Even after review by the Attorney General, 72% of the cases approved for death penalty prosecution involved minority defendants.”
Does anyone want to suggest that this is the natural outcome of a completely fair process bereft of racial prejudice? What is left to conclude then? That minorities are simply more inclined to commit such acts than others and be punished for them?
In terms of juries and minority composition, one need not compile statistics on this issue as there is already a legal basis for this known as the Batson claim.
Nevertheless, even though this is now something that can form a basis of legal challenges, it has still been ignored as was evidenced earlier this year by the Supreme Court in a high profile appeal.
One must also have one’s head stuck in the sand to not think that the composition of the jury in the high profile Luis Ramirez case had anything to do with two defendants being cleared of the most serious charges. In short, the make up of juries is a similar phenomenon as to the current discussion of the make up of the Supreme Court!
And really, can we deny the racism of the criminal justice system when its highest court in the land has been composed historically of 107 white male justices out of 111 seats? Or when it has returned such memorable decisions over the course of time such as Dred Scott, Plessey v. Ferguson, and Korematsu v. US?
Lastly, since the California budget is a constant topic of discussion here, why keep California’s reportedly dysfunctional death penalty system when it is, above all, costly to the state to the tune of 100 million dollars annually? If an appeal to morality, fairness or logic is not in order, perhaps the last recourse is an appeal to the pocketbook!
