Dan Avery will stand on his head if you will vote against the MacLean Recall…

Dan Avery, a very vocal opponent of the campaign to recall Mission Viejo Councilman Lance MacLean, has been sporadically sending me emails attacking Dale Tyler. Apparently Avery has been trying to find something, anything, on Tyler.
Tyler is one of two candidates vying to replace MacLean. The other is MacLean supporter Dave Leckness.
Well, the other day Avery sent me yet another email, this time informing me that Tyler owns some cars with out of state license plates.
That’s it folks. The best the MacLeanites could do was to attack Tyler because some of his cars have Indiana plates. Unbelievable. Talk about grasping at straws…
Tyler told the Register that he thought he was in the clear as he owns property in Indiana. That certainly sounds reasonable.
Tyler has since recitified the situation. But the MacLeanite shills over at the dreadful Red County blog are accusing Tyler of tax evasion. These are the same yahoos that supported the Measure M tax increase! I guess they are Republicans who really love taxes.
MacLean attacked a guy, at UCI. And he voted himself lifetime health benefits, at the expense of the people of Mission Viejo. That’s just the tip of the iceberg. He most certainly deserves to be recalled!
As for Tyler, he has shown us that he, like us, is all too human. He made an honest mistake. I think the voters will understand. And I think they know that a vote for Leckness will be a vote for the sort of irresponsible spending that MacLean has come to be known for.
And Avery? He is certainly a frustrated guy. I hope he can keep it together when MacLean gets recalled and Tyler replaces him!
By the way, we had to ban Avery, here at the Orange Juice, after he started sending me threats via email. I don’t know why the MacLeanites are so desperate to keep MacLean in power. It just doesn’t make sense. And Avery is supposedly a progressive Democrat! There is NOTHING progressive about MacLean. But I guess he is for universal health care. Well, for Mission Viejo City Councilmembers at least…

Tyler admitted to paying circulators in cash under the table, and is being investigated by the FPPC. Probably violated some unemployment laws too.
Tyler says he has lived in Mission Viejo for 22 years, but just now got caught with out of state plates.
You forget to mention he has NEVER had a California drivers license, ever. I think the Mission Viejo voters are interested in this.
He is under investigation by the FPPC, the DA, the DMV and the CHP. That hardly sounds like “all” the Macleanits have on Tyler. Pretty substantial to me.
If this were some lib running, you would be all over this. But typically, you just dismiss it. If you are so confident in Tyler, how about you volunteer to pay all of his penalties and fines when this is all done?

Get a life. We have posted your recent comments with the same arguments on other Gilbert posts. Even Frank Ury wants to divert attention away from the city manager’s last minute request to Amend his contract when the normal schedule for doing so is in May with City Council action being taken on or before June 30th.
Mr Ury dodged my inquiry on this last minute “fast track” request and raises the same points as contained above and in Sunday’s Register.
At 8 p.m. tomorrow the polls will be closed.

Mr Ury is all bent out of shape because I forwared a comment from Fullereton Mayor Shawn Nelson, one of our readers, who questioned this request from Dennis Wilberg without his giving us anything in return.
In truth Dennis must feel the recall is successful and he is throwing mayor Lance MacLean under the bus by raising the question of this unusual timing along with requesting changes after signing five prior Agreements.

I have been fighting RINO’s like MacLean and Ury for years. I cannot stand hypocrites who talk about being conservatives, but then turn out to be tax and spend liberals. And I am not talkling about social issues, as I am very liberal in those areas.
As for late reports, the Secretary of State just issued a list of those who filed late reports. It went on for nundreds of entries and included many county political parties. The FPPC rules are so difficult to follow that many folks make such mistakes.
And this whole mess about a driver’s license is laughable. So what? Is there some rule that says you have to have one in this state? I have been involved in politics for over twenty years and have never heard of that. What about polliticians who don’t drive? Sure, that is likely a small number, but those guys wouldn’t even need a driver’s license, would they?
I am not trying by the way to rally anyone. I am just pointing out that the MacLeanites arguments are weak and pathetic.
The issues is Lance MacLean nothing else !! He has/had a proven track record of abusive actions. This has been well documented.
As to Dan Avery he was blocked from this blog for good reason. You just might look at Avery’s past to figure him out. Start with his SDS (Students for Democratic Society ) days of trashing campuses, and intimidating students and faculty.

Oh please! Tyler has now broken the law 31 times during the recall process. When all the investigations are done by the DA, the FPPC, the DMV and the CHP Tyler may even have to do some jail time. This is hardly an oh shucks guys he goofed. He has avoided paying vehicle registration fees on his cars for 22 years. He has not had a CA driver’s license for that same amount of time. The man paid 22 petition circulators over $15,000 IN CASH. When I reported that to the FPPC, there was an audible gasp by the investigator Ms. Rindahl. The 5 circulators paid the most, live in cities out of town and the lady from San Juan continues to work for cash (she admitted this) and none of that has been reported for months. Those of you who think these are just tiny mistakes will one day realize the DA, FPPC, CHP and DMV don’t agree with you. You are right about one thing, these laws were broken in full view of Councilwoman Cathy Schlicht, and Larry Gilbert, Connie Lee, Joe Holtzman and the gang. The real victims here are the residents of MV. They need to speak up by voting NO Recall and then vote for Dave Leckness just in case too many people have been hood-winked by this lawless bunch of scam artists. Sharon Cody

This recall is about Lance MacLean.
Perhaps someone can tell us what the “quid pro quo” is with the deputies union. They have spent about $100,000 that we know about. Someone paid for four voter polls over the past few months that has not been reported locally.
Perhaps someone can explain why the City Manager wants a fast track Amendment to his Contract tonight in which he wants us to remove possible causes of action relating to “Dishonesty, fraud and self-dealing” as to any future charges of potential “misconduct” if warranted.
As many have said. If the city council approves this 6th annual Contract Amendment tonight we will “remember in November.”

Councilman Frank Ury has sent me three emails in the past 48 hours trying to bait me on the Register story regarding Dale Tyler yet he fails to respond to my questions on the requested Contract Amendment which he needs to justify.
He may be a retired engineer with a wall full of degrees but I await the outcome of his contract negotiating skills tonight.
He is not happy that a peer named Shawn Nelson, attorney/mayor of Fullerton, called it correctly in another blog post.
Having personally negotiated multi-million dollar high-tech contracts with billion dollar firms it is a give and take process.
What I have seen on tonight’s “routine” Consent Calendar Agenda is a one sided “entitlement request” with the city manager giving up ZERO.
Does Dennis Wilberg have something on the council majorty. Did he have this in the bag before placing it on the Agenda? As insiders practice the political reality of being able to “count to three” was there a Brown Act violation involved in setting this bold Agenda item? Who knows.
Within 33 hours the recall results should be final!!

You guys must not pay attention to your own polls….The grass roots of the “NO” Recall seems to be working. From what I have seen they have done it with integrity. Something that Dale Tyler is truly lacking. Anyone who has bought a car knows that you have 20 days to get it registered, not 20 years. So, Dale claims to have lived here for 22 years but never got a California Drivers Lic? You defend this? We should vote for someone that clearly doesn’t respect our laws? I don’t love MacLean, but I despise tricks used to get an advantage, such as this recall. I will not vote for Maclean in November when he comes up for relection. I have never posted in any blogs however I was forwarded a comment and I have had enough. I was open to both sides but honestly was leaning towards the recall because I don’t like Mr. MacLeans personality. However, a couple things happened. 1) I was harassed by young men at Albertson’s who told me that Lance MacLean was violent against a woman and should be recalled. I researched it and found that to be false. 2) My neighbor hung up her own private “No Recall” sign on her private property and it was repeatedly destroyed. The recall side is fighting so dirty without integrity that regardless of whether I like Mr. MacLean or not, I am voting No Recall and for Dave Leckness. People of MV, do the research on this – read both sides and you will find that the accusations are false and/or distorted. MV is a GREAT city – we are consistently in the top 10 safe cities, we have excess funds and great community pride and programs. Don’t let these people trick you into getting their majority so they can change the things that make MV so special. Dale Tyler is their candidate and his complete lack of integrity and accountability says it all. His wrongdoings are showing up daily – let’s just hope for his sake (and my eyes) that unlike Sen Elect Scott Brown, there are no Cosmo pictures from his past. No Recall!!

Glad to know that you have been here 27 years. Is this an endurance contest? We have lived here for 31 years. So what does that prove?
We did make one mistake in supporting the 2002 campaign of Lance MacLean.
Dale Tyler my puppet. Are you kidding? For starters he is his own man. Secondarily, prior to this campaign, we were not in any regular communication. In fact we were on opposite sides in the 2006 election.
Bitter. No, disappointed, yes. Because I convinced so many friends to vote for Lance in 2002 before he flipped.
Unlike Lance who promoted a tax increase, Dale and I worked together fighting a major tax increase a few years back but that’s the extent of our interaction.
And yes, we did vote for Dale over Dave as stated previously. Simply compare the two interviews where one candidate is serious and knowledgable of the issues during this recession while the other wants to promote a concept to “wave at a cop” yet admitting no knowledge of the recall issues, the Right to Vote Initiative, the dog park debate and the expansion of a tennis center.
I would hire Dave in a minute to be an MC. He is a funny guy. But he is not prepared to be a member of our City Council and admitted so as documented in his reply to the interview that anyone can read on the Juice.

How can you dismiss a tax cheater’s actions? There is no doubt who the better candidate is. I’m sure you think Kathy Schlict is prepared and qualified to be on city council. It was my attendance at a city council meeting, observing Kathy, that energized me to be more active in MV affairs. She’s your right hand on the council isn’t she Larry? As far a the dog park, every quality city should have one. The expansion and upgrade of the Natadore and tennis center is what a 1st rate city does to maintain and improve facilities that are used by residents and are sources of civic pride. You are an extreme libertarian Larry, and most of the residents of MV are not cut from your cloth. You are on the outside looking in and angry that you can’t have your way with this city. Get used to it, you never will.

I have a good friend that lives in Casta and I see ZERO political signs in Casta. So having a neighbors sign vandalized in Casta is hard to believe. Or maybe Joyce S. has given the word that all signs must go—so you might want to talk to her. As to MacLean–you just have not done your homework–I suggest going to the OC Weekly and reading their article on MacLean. My good friend Diane Greenwood called me minutes after Lance MacLean verbally assaulted he. Diane still has nightmare over that issue. I have Diane’s phone number if you want to call her—by the way Frank Ury arrived soon after the incident with MacLean and insisted that the police take a report. Of course that was before Ury sold his soul to the devil for a few silver coins and joined up with MacLean to raid the city treasury.

I find this posting by Francis fairly amusing. I recall being told about an incident where Francis caused a traffic collision in the city and while the lady was sitting in the driver’s seat of her car injured, commenced to screaming at her. I was told he was later found at fault. It seems a lot of people are trying to make MacLean out to be some sort of psycho and yet these same people have flown off the handle themselves at times. I’m going to guess this is a regular occurrence for Francis because who else but an ill tempered person would scream at an injured woman for something he did. I’m no MacLean supporter but if the call to arms against a man is being made by the likes of Francis, Cathy, Brad and the other city ilk then that’s all I need to see to know not to vote for it.

Folks. I just found out that our council majority just voted 3-2 to amend the city managers contract while he gave up nothing in return. Therefore if we discover that he has engaged in any fraud ,self dealing or dishonesty we no longer have any way to terminate his severance package should any discovery lead to legal recourse.
As I stated tonight we will “remember in November” which impacts Trish Kelley who is up this year and Lance if he survives tomorrows recall election

Joe Holtzman unlike Frank Ury is not a public figure. As such targeting him is inappropriate. You want someone to beat up on try me. I sat for over an hour in chambers while the mayor allowed a parade of public speakers to attack me and others urging the city attorney to file a lawsuit against several people including myself. We shall see who is smiling tomorrow.
Larry I agree with you about personal attacks. What I don’t agree with is that I blogged (for the first time today) and Joe Holtzman immediately called me a liar. So I guess you and he can say and do whatever you want and then cry foul when you are called out on it. What is your angle? Concerned citizen? Or, do you want a job from city council or the city manager? You are carrying on that some people need to lose their jobs (even though these people have done pretty good jobs) and that we need to vote in a guy who has committed some very unethical (and illegal) things and is under investigation. E. Dale Tyler has proven himself to be an irresponsible and unethical candidate. No matter how the “YES” group tries to spin this = Dale Tyler has actually become an embarrassment to our community. His lack of ethics and common sense is very hard to understand. It has become obvious that a minority group in our City is trying to gain a majority on the City Council through lies and deceptive practices. Mission Viejo is truly a great City to live in. I would not want to see it changed in a negative way by a small group of mean spirited, irrational and negative people. There is no actual reason to change the City Council membership now. The recall election is a complete waste of $270,000. This is tax money that could have been spent in many other productive ways. There is a general election in November and these issues should have been resolved then. I ask that residents of Mission Viejo take a close look at our City and our quality of life. Do you want to see it lessened by the actions of a this minority group of residents? I think not. I have lived here for over 25 years and I fear for our future if this gang gains a majority on the City Council. If they dislike this City so much- they can live somewhere else (please). I understand Indiana is a fine place to live. Vote “NO” on this recall and for Dave Leckness as the best candidate in the unlikely event this unneeded recall is passed. Last night was a joke. _The biggest laugh was Butterfield and Cody calling for the city to sue the activists_. If that be the case we should remind Butterfield and her gang that when Butterfield and Withrow *were convicted–yes convicted of violations of the Brown Act*. *we now want the money back spent defending their convicted gang.

Also we want Butterfield to pay back the money for the wasted three times the city went into court over the Lake Promenade when she and the city lost three times in court to the Lake Association. I would say with interest and inflation those two capers cost the city now close to $402,000.
John, I know you would like to engage in character assassination and that just proves my point you have NO knowledge of what has/is going on in this city. You missed a great council meeting last night where I was hammered by some former mayors and their supporters as if I am running this recall activity. No, Larry Gilbert does not warrant any credit for the work of many other MV taxpayers. Bring it on.
Now now Francis, Please calm down. Isn’t there a rule or at least a show of etiquette that governs how many people that you can take a swing at in a single post. Your shotgun approach is symptomatic of a very anxious and irritable soul. I suggest that you endure further study with your master Larry before you become dismissed as a raving and bitter bafoon. This is the first time during this recall election that I have written to a blog. Joe, you don’t have to be shy about writing my whole name. I am not ashamed of my views or decisions I have made in the case of the recall. You should however, find out facts before you state them as fact. I am on the Board of Directors of Casta del Sol and because of that I have stayed away from trying to influence Casta residents in the recall issue. Many, many Casta residents have called me and asked how they should vote. Up until the past couple of days I have told them how I voted and explained the facts to them so they could make their own decision. The last two days I have come right out and told them how to vote. You all have shown your true colors (I have to apologize to Brad for not mentioning his name last night along with all of you) right here in this blog. You are not the kind of people we need running Mission Viejo. Thank you “Casta del Sol Grandma” for your comments. I don’t know who you are but would love to meet you. We need open minded, thinking people like you in our community.

Larry and his friends overcame great odds and were vastly outspent, but they won.
And in an election this close, this blog may have been the difference.
